Terms and Conditions – Sewing Lessons

(Effective 21/08/2025)
These Terms and Conditions (“Terms”) govern the provision of sewing lessons and associated services by The Crafty Seamstress (“the Service Provider”, “we”, “us”, “our”) to the client or student (“you”, “your”). By booking and/or attending a class, you acknowledge and agree to these Terms.

1. Lesson Types and Eligibility
1.1 Lessons are offered as:
   a) Private one-on-one sewing lessons (ages 13+);
   b) Parent and child lessons (child aged 7+ unless otherwise agreed in writing); and
   c) Specialised “Learn to Do Your Own Alterations” sessions.
1.2 Unless expressly stated otherwise, lessons are for adults and teens aged 13 years and above.
1.3 We reserve the right to refuse enrolment where the lesson type or skill level is unsuitable for the student.

2. Bookings and Payment
2.1 Lessons are by appointment only and must be booked in advance.
2.2 A booking deposit of $50 per student per session is payable at the time of booking to secure your place.
2.3 The $50 deposit will be deducted from your total fee if you attend the booked lesson. If you cancel or fail to attend, the deposit is non-refundable as it represents a genuine pre-estimate of the loss suffered by the Service Provider, including administrative time, preparation of lesson materials, and loss of the reserved time slot.
2.4 The remaining balance must be paid in full prior to or on the day of the lesson.
2.5 Lessons are not transferable to another person without our prior written consent.

3. Cancellations, Rescheduling and Missed Classes
3.1 Cancellations or rescheduling requests must be made at least 48 hours before the scheduled lesson.
3.2 Late cancellations (less than 48 hours’ notice) or non-attendance will result in forfeiture of the deposit.
3.3 Where lessons are part of a package or course, missed classes will not be refunded or credited unless prior arrangements are made in writing.
3.4 Students must not attend lessons if unwell or displaying symptoms of contagious illness. In such cases, lessons may be rescheduled at the Service Provider’s discretion. Deposits remain non-refundable but may, at our discretion, be credited towards a future lesson.

4. Class Conduct and Safety
4.1 Students must follow all safety instructions and use equipment in the manner demonstrated.
4.2 Appropriate personal protective equipment (PPE) and clothing must be worn at all times, including:
   a) enclosed, hard-sole shoes;
   b) no loose or long sleeves that may catch in machinery; and
   c) long hair securely tied back.
4.3 We reserve the right to refuse participation or terminate a lesson without refund if a student’s attire, behaviour, or use of equipment presents a safety risk.
4.4 For parent and child lessons, the parent or guardian is responsible for supervising the child at all times, and remains fully responsible for the child’s conduct, safety, and behaviour. The Service Provider accepts no liability for injury or damage caused by the child’s actions.
4.5 We reserve the right to refuse service or discontinue lessons where student behaviour is inappropriate, abusive, or otherwise prevents the safe and respectful running of classes. In such cases, deposits will be forfeited.

5. Equipment and Materials
5.1 Sewing machines, tools, and standard materials are supplied for use during lessons, unless otherwise specified.
5.2 Students are welcome to bring their own sewing machine and tools, provided they are in safe working order.
5.3 We are not responsible for any damage to or loss of personal equipment or materials brought to the class.

6. Health and Medical Conditions
6.1 Students must advise the Service Provider in advance of any medical conditions, injuries, or additional support needs that may affect participation.
6.2 The Service Provider is not responsible for injury or issues arising where such information has not been disclosed.

7. Intellectual Property
7.1 All lesson plans, teaching materials, and patterns provided remain the intellectual property of the Service Provider and may not be reproduced, shared, or used for commercial purposes without our written consent.
7.2 Students may make personal use of patterns or techniques learned in class but must not resell or redistribute the materials provided.

8. Limitation of Liability
8.1 While we take all reasonable care to provide a safe learning environment, sewing involves the use of sharp tools, needles, and electrical equipment. Participation is at your own risk.
8.2 To the maximum extent permitted by law, we are not liable for injury, loss, or damage sustained during or as a result of the lesson, except where caused by our negligence.
8.3 The Service Provider holds appropriate business insurance, including public liability cover, to support the safe and lawful operation of lessons.

9. Photography and Promotion
9.1 With your consent, we may photograph or record lessons for promotional purposes, including but not limited to social media, website, and marketing materials.
9.2 Consent may be withdrawn at any time in writing.

10. Force Majeure
We are not responsible for cancellations or delays caused by events beyond our reasonable control, including but not limited to illness, extreme weather, supply issues, or equipment failure.

11. Minimum Numbers (if applicable)
If a class requires a minimum number of students to proceed and enrolments fall below this number, we reserve the right to reschedule or cancel the class. Students will be offered an alternative date or credit.

12. Governing Law
These Terms are governed by the laws of Western Australia. The parties submit to the non-exclusive jurisdiction of the courts of Western Australia and any courts competent to hear appeals from those courts.
